Cis people, how many times have you been asked to describe how you masturbate, and what you think about when you do, to access healthcare on the NHS?

22.11.2025 14:37 โ€” ๐Ÿ‘ 1585    ๐Ÿ” 446    ๐Ÿ’ฌ 75    ๐Ÿ“Œ 35

That last bit I think is particularly important in terms of passing ethical approval. the bar is not low for physical examination of minors and the purpose of the study (imo) does not require that. That said, it only requires an NHS ethics board to approve and we know what they think of trans people

22.11.2025 14:05 โ€” ๐Ÿ‘ 2    ๐Ÿ” 0    ๐Ÿ’ฌ 0    ๐Ÿ“Œ 0

Thereโ€™s ofc no difference in the way PBs work on trans vs cis people, the govโ€™s justification for the trial is that thereโ€™s less published work on the specific treatment of gender dysphoria. But thereโ€™s tests theyโ€™re including in the trial (invasive physical examns) that are entirely unnecessary

The tendency of Coroners to ignore guidance from the Chief Coroner, the reality of trans existence, and the wishes of bereaved parents, and express their own views in the death certificate, is both contemptible and unlawful.

We have a legal team ready to go; we will challenge it in the High Court.

One possibly for @goodlawproject.org and other legal minds but this is the sort of thing that in my world (academic publishing) would make me confident enough to make a decision to retract a paper

This is the sort of discovery that would lead to an academic paper being retracted if the Supreme Court decision was peer reviewed work.

Fundamentally flawed and should have been known to be so at the time of decision

6/ โ€They could themselves be treated as a comparator by a male applicant.โ€

A trans woman being able to work at a womenโ€™s hospital shows that a cis male applicant who was rejected was not directly discriminated against.

This is how the DfEE officials reasoned it in 1999.

21.11.2025 17:29 โ€” ๐Ÿ‘ 112    ๐Ÿ” 9    ๐Ÿ’ฌ 2    ๐Ÿ“Œ 0

4/ โ€œThe purpose of this provision is to enable a person
who has gender reassigned to have all the protection of the Sex Discrimination Act and Equal Pay Act.โ€

This directly contradicts the Supreme Courtโ€™s position that gender reassignment does not change sex. For the purposes of equality, it does.

21.11.2025 17:22 โ€” ๐Ÿ‘ 151    ๐Ÿ” 24    ๐Ÿ’ฌ 2    ๐Ÿ“Œ 0

3/ โ€œFor example, it is envisaged that the provision would allow a
suitably qualified male to female transsexual to be able to take up employment in a single sex women's hospital. They could themselves be treated as a comparator by a male applicant.โ€

This shows, quite bluntly, the EHRC is wrong.

Recognition of the new gender identity following gender reassignment:
6. The Regulations should indicate that, for employment purposes, a person is to be
treated
as
their reassignedsex on completion of gender reassignment, i.e. when he or she is
living permanently in the new gender. However, it should be clear that this provision applies
only to equal opportunities legislation (i.e. SDA, Equal Pay Act and section 62- 64 Pensions
Act). This would then ensure that anysearches carried out by the Police or Prison Service are
still subject to the provisions of the Police and Criminal Evidence Act and the Prisons Act,
which prohibitsearches by oppositesex. The purpose of this provision is to enable a person
who has gender reassigned to have all the protection of the SDA and EgPA. For instance, they
should be able to take advantage of a job for which there is a Genuine Occupational
Qualification for the new sex. For example, it is envisaged that the provision would allow a
suitably qualified male to female transsexual to be able to take up employment in a singlesex
women's hospital. They could themselves be treatedas a comparator bya male applicant.
There are of course difficulties in determining when gender reassignment is completed. Many
transsexuals do not undergo reconstructive surgery; and hormonal treatment will last
indefinitely, whether surgery is undertaken or not. The policy anticipatesa point at which a
person who has reassigned will be treated as their new sex for the purposes of employment for
which there is
a
GOQ for that sex. In doing so, a distinction will need to be made between
those people who are still in the process of reassignment, to whom temporary exceptions may
exist in certain circumstances. \t was therefore considered appropriate that this process would
โ€œendโ€ on completion of surgery; or, where that is not planned, the end of the two year trial of life
test. (During the period of the life test, a
person would be undergoing gender reassignment) Itโ€ฆ
