It is time again for my periodic plea for law reviews to stop using β€œSupra” it takes away what is good about footnotes and makes them even worse than endnotes.

As the ABA discusses the proposal to double the required number of experiential credits, here's a very informative and timely paper from Chilton, Joy, and Rozema. papers.ssrn.com/sol3/papers....

It provides grounds for real skepticism, and so far I have not seen good counter-evidence from the ABA.

By now I should know that thoughts about how much writing I will get done over the summer are sheer self-deception. But apparently basic induction always succumbs to irrational optimism.

I understood the list to be what licenses or supports a further conclusion (that OLO is our law) not the content of what OLO is to them.

I don’t read Bill as saying they are OPM folks. He separately addresses OLO and OPM in the positive law section.

I think there are two separate claims: (1) do they claim that OLO is our law (I think, yes). (2) are they committed to looking beyond what is plain (whether OLO or OPM). Their body of work strongly suggests they are. And that is enough for Bill’s point even if they aren’t going for 51-49, no?

Does Original law Originalism have more content than plain meaning Originalism? If so, then are you suggesting that Baude and Sachs aren’t claiming that original law Originalism is our law?

Does β€œfallacy” connote something that I am unaware of? I wouldn’t have thought it had any more or less expressive component than β€œwrong” or β€œmistaken.” It’s just a particular way of going wrongβ€”via a bad inference.

Yes! Supra and infra take all that is good about footnotes and replace it with all that is bad about endnotes.
