It is time again for my periodic plea for law reviews to stop using βSupraβ it takes away what is good about footnotes and makes them even worse than endnotes.

07.09.2025 14:51 β π 4 π 0 π¬ 0 π 0As the ABA discusses the proposal to double the required number of experiential credits, here's a very informative and timely paper from Chilton, Joy, and Rozema. papers.ssrn.com/sol3/papers....
It provides grounds for real skepticism, and so far I have not seen good counter-evidence from the ABA.
By now I should know that thoughts about how much writing I will get done over the summer are sheer self-deception. But apparently basic induction always succumbs to irrational optimism.

10.03.2025 19:25 β π 4 π 1 π¬ 0 π 0I understood the list to be what licenses or supports a further conclusion (that OLO is our law) not the content of what OLO is to them.
14.03.2025 21:08 β π 0 π 0 π¬ 1 π 0I donβt read Bill as saying they are OPM folks. He separately addresses OLO and OPM in the positive law section.
14.03.2025 21:04 β π 1 π 0 π¬ 1 π 0I think there are two separate claims: (1) do they claim that OLO is our law (I think, yes). (2) are they committed to looking beyond what is plain (whether OLO or OPM). Their body of work strongly suggests they are. And that is enough for Billβs point even if they arenβt going for 51-49, no?
14.03.2025 21:02 β π 0 π 0 π¬ 1 π 0Does Original law Originalism have more content than plain meaning Originalism? If so, then are you suggesting that Baude and Sachs arenβt claiming that original law Originalism is our law?
14.03.2025 19:27 β π 2 π 0 π¬ 1 π 0Does βfallacyβ connote something that I am unaware of? I wouldnβt have thought it had any more or less expressive component than βwrongβ or βmistaken.β Itβs just a particular way of going wrongβvia a bad inference.
13.03.2025 16:53 β π 0 π 0 π¬ 1 π 0Yes! Supra and infra take all that is good about footnotes and replace it with all that is bad about endnotes.
