We have been speaking to and hearing from women and trans members in a broad spectrum of workplaces, across the UK, gathering evidence and feedback about members' feelings and experiences following the ruling. Labour women’s event in chaos over trans law Party told to drop women’s meeting with members on ruling executive at odds with Government position The Daily Telegraph20 May 2025By Hayley Dixon special correspondent Labour is set to postpone its women’s conference as the party descends into chaos over the Supreme Court trans ruling. Confidential advice sent to members of the National Executive Committee recommends that they cancel the event in order to avoid legal action and political embarrassment. The document sets out that the “only legally defensible alternative” would be to limit the event to biological women, but does not explain why this is not the preferred option. LABOUR is set to postpone its women’s conference as the party descends into chaos over the Supreme Court trans ruling. Confidential advice sent to members of the National Executive Committee (NEC) recommends that they cancel the event in order to avoid legal action and political embarrassment. The document sets out that the “only legally defensible alternative” would be to limit the event to biological women, but does not explain why this is not the preferred option. The advice notes that Labour’s “positive action” policies, of which the conference is a part, have until now operated on the basis that biological men can be included if they selfidentify as women. It states that such positive action policies including allwomen shortlists will have to be on the basis of biological sex rather than gender identity.

The amendment reads: To move the following Clause— “Directions to public authorities on recording of sex data (1) The Secretary of State must, within three months of the passage of this Act, issue regulations relating to the code of practice set out in section 49 of this Act which require public authorities to— (a) collect, process and retain sex data only where it is lawful to do so in accordance with data protection legislation; (b) request and record sex data accurately, in every circumstance where sex data is collected, in accordance with following category terms and definitions— (i) ”Sex” meaning male or female only based on “sex at birth”, “natal sex” or “biological sex” (these terms carrying the same meaning and capable of being used interchangeably); and, (ii) in addition, where it is lawful to do so in accordance with data protection legislation and the Gender Recognition Act 2004, “Acquired Gender” meaning male or female only, as recorded on a gender recognition certificate issued in accordance with the Gender Recognition Act 2004.
The UK Data (Use and Access) Bill is currently being debated in Parliament and anti-trans campaigners are trying to amend the Bill so it requires public authorities to collect data about 'biological sex' (see below).

I am aware of the UK Supreme Court ruling in For Women Scotland v Scottish Ministers (2025] UKSC 16. However, this ruling is incompatible with the European Convention on Human Rights which the UK ratified in 1951, in particular Article 8 'Respect for private and family life'. This was decided in the case of Goodwin v UK [2002] 35 EHRR 447 which provided that contracting states must have an effective method of acknowledging gender-change. If you are to continue to deny me use of facilities appropriate to my gender I will require your name, the name of your organisation and details of the policy or instruction you are following as the denial is likely to be the subject of litigation. translucent.org.uk

We will be taking some time to look at the decision in full, especially where the ruling could create legal uncertainty and discrimination in employment, education, health services etc. We will issue further statements as appropriate. We would like to take this opportunity to send a message of solidarity and comradeship to the trans community, many of whom will be experiencing fear and uncertainty in what lies ahead.
