Ranking member of the House Homeland Security Committee Bennie G. Thompson said in a statement “Mobile Fortify is a dangerous tool in the hands of ICE, and it puts American citizens at risk of detention and even deportation.” He also said “ICE officials have told us that an apparent biometric match by Mobile Fortify is a ‘definitive’ determination of a person’s status and that an ICE officer may ignore evidence of American citizenship—including a birth certificate—if the app says the person is an alien. ICE using a mobile biometrics app in ways its developers at CBP never intended or tested is a frightening, repugnant, and unconstitutional attack on Americans’ rights and freedoms.”
New incredible detail here: ICE says a match in its facial recognition app Mobile Fortify is a "definitive" determination of a person's status, and that this overrides birth certificates. This is an app ICE is using in the field to scan people

I’m sorry, if someone has a birth certificate that proves they were born here but a mobile app with face recognition software disagrees, they will side with the app?
What?
We’ve got money for the Jeffrey Epstein memorial ballroom no one asked for but not enough money to help feed the kids of people who work at Wal-Mart.
Only in America.
The Oligarchs have definitely invited the voting pitchforks, if we survive this current totalitarian grab, that will likely define the next couple of decades.

There's a reason why Carnegie and the Rockefellers poured money into institutions. Gutting institutions and making it harder for the masses to survive is a...choice.
This thread makes a point I find myself coming to often these days.
It's hard to make this point in a way that doesn't sound like a threat, but it's just a fact that for centuries the wealthy in America worried that the mob would come get them and did all they could to avoid that fate.
I think you could put the Supreme Court into this as well. The idea of zero repercussions for terrible acts that effect so many people only makes them more troublesome; and that kind of power needs to have a check, wherever it comes from.

I'm still confident the guy who used to bull's-eye womp rats back home will join with all of us to stop this insanity.
Hopefully before we have to get to the barricade stage of the movie.

Trump screws his voters again: He just denied disaster aid to Maryland (while giving it to red states). But I took a look and it turns out the suffering Maryland counties are in Appalachia and backed him by 40 and 54 points.
On the pod, @stevebenen.com and I discuss:

It gets crazier. Source in Maryland Gov Wes Moore's admin tells me they informed Trump officials that the ailing counties were in Appalachia, and the Trump people were surprised to hear this!
(Supports @jamellebouie.net's point about MAGA's Balkanized vision of US)

Your daily reminder that Trump keeps failing his cognitive test, every time he thinks it is an IQ test.
Donald has NOT gotten the animals correct, even once, and he reads "Person, woman, man, camera, TV" from a cue card every test, even though the words are different now.

It's clearly unconstitutional coercion by the DOJ, but our Constitution is now hanging by a thread thanks to zero oversight by Congress & a complicit SCOTUS Republicans.
In a sane world, Bondi, Blanche & Trump would all be impeached for the illegal targeting of Kilmar Abrego Garcia.
Abrego's attys protest that the new designation comes 2 weeks after a 10/10 hearing on whether to release Abrego due to govt's sluggish/chimerical efforts to remove him to Uganda, Eswatini & Ghana. Abrego's motion is here:

At 2pm Judge Xinis is holding a 'virtual' hearing on govt's new stated plan of sending Abrego Garcia to Liberia by 10/31. Abrego says it's too late to switch again & govt must 1st try Costa Rica (already offered, but only if he'd plead guilty). I'll try to live blog here for @lawfaremedia.org .

4/ ICE is waving guns around like this is a war zone, not a peaceful American city.

It's hard to overstate how fully engaged Chicago and the surrounding suburbs are in this ICE madness. There are neighborhood watch alerts, spontaneous crowds gathering outside schools at pick up & drop off plus madly blowing whistles and honking car horns, this city is fighting back and hard.

Immergut concludes this part of today:
"I'm going to have a decision by Monday, if not before."
She's now discussing merits trial preparations with them.
Unreal to hear Yaakov Roth try to explain away why DOJ didn't appeal the second TRO.
I've watched DOJ appeal amended orders, subsequent orders, second orders, extensions of orders, and more. It's unreal to say that DOJ thought it shouldn't appeal a TRO with a different, expanded scope.
Am I reading this right?
Did DOJ really lie this flagrantly to the 9th Circuit Court of Appeals?
Am I misunderstanding something?
