This is a broader problem with much international law. Treaties made to deal with serious harm have been widened in scope too far and are interfering in legitimate balancing decisions that nation states are wanting to make.

I agree that 1.5C is no longer achievable, 2+C is likely and we should prepare for this. But Im not sure 5C? That would mean not only are there no more NDC improvements, but even existing commitments not met. My money FWIW is on about 3-4C.
