As long as he’s POTUS, he retains the power to act. SCOTUS can block his actions, but he will simply tweak his justification & continue. We’ve seen this pattern before.

He’s not making a good faith effort to follow the law. He’s on record, often, saying he has the power to do whatever he wants.
