The best proof that sex is a social construct is how cultures treat their intersex population—esp. their medical practices around intersex newborns and kids, and what they hide/“fix” about them so they can lead “normal” lives.

What intersex people should know: The proposed rules have exceptions for “treating” a “medically verifiable disorder of sex development.” These aren’t about guaranteeing access – they are exceptions for intersex genital mutilation on infants and young children.Intersex youth who need coverage for care like hormones could face hurdles to “prove” their variation qualifies. Coverage might still be denied if care does not align with sex stereotypes.Both trans and intersex patients could lose access to clinics whose funding is at risk.

The Trump administration proposed two regulations in December attacking gender-affirming care for trans youth and punishing hospitals for providing this care. Both include carveouts for intersex genital mutilation.

Yes - care may depend on what sex is listed on a birth certificate. Even for intersex people seeking care the state sees as aligned with their sex, they are likely to have more barriers and steps to prove their intersex variation.

The hypocrisy is clear. Banning gender-affirming care denies the bodily rights of transgender adolescents and defies respected medical, scientific, and mental health recommendations. The actual genital mutilation happening on intersex infants and young children, in the same bill text, is endorsed.

The thing is, you can't make trans and intersex people nonexistent, you can only make them suffer.

The US House has passed HR 3492, the most extreme gender-affirming care ban Congress has considered yet. The bill's exemption for nonconsensual surgeries on intersex children is the first that also admits they are a form of genital mutilation.

Besides the fact that TRANS WOMEN ARE WOMEN, some cis women are born without uteruses, some intersex people are born with uteruses and can have any gender identity, and also my mom didn’t stop being a woman when she had a hysterectomy.
