There is a real, genuine 1st Amendment crisis in the United States right now.

The government is openly retaliating against anyone with a viewpoint it doesn't like: Pro-Palestinian protesters, law schools teaching Black History, pro-immigration public service loan forgiveness seekers.

I presume that this is going to go into the exhibits filed in New York’s case soon.

I do think we are soon going to reach a point where judges are going to have to start imposing sanctions.

Individuals bear the costs of speaking out but don't capture the collective benefits for democracy. A classic externality - and one that could doom our system of government.
