Judge Smith seems skeptical of the state’s argument that courts have no review if OCM didn’t do something mandated by law. They may not be able to review applications, but they can review if the process wasn’t followed, the Judge appears to be hinting at.

Each lawsuit has slight different plaintiffs, and atty is explaining unique harm to Transportation License applicants. Also mentioning technology issues with portal leading to non-accepted applications. But they got confirmation emails.

This case is centering more on when deficiency notices were sent and why. Apparently the “deficiency notices” that were sent in Oct were actually “Requests for Information”, which OCM argues is legally different.

My own opinion: OCM’s argument on this one is 💩

Atty for Aranguiz is reminding the judge that “no denial reason was given” for his client, meaning that the denial was not legal under law. Also pushing back against the idea that a purchase option agreement was illegal/required denial.

Atty for OCM continues to argue that not everything in government requires judicial review, including, per OCM atty, Social Equity Preapproval Application denials.

It’s disappointing to see the #Minnesota Office of #Cannabis Management appear to have contempt for the people they were created to help support & regulate. I’ve long been a supporter of OCM, but it’s clear that mistakes were made with the SE applications and there must be relief before any lottery.
