If the Supreme Court cannot defend the clear wording of the Constitution, then there is no Constitution. If there is no Constitution then there isn't a point in having a Supreme Court.

Keep the gas tax but reduce it by a small VMT. In my state, the odometer reading is part of the annual inspection. Set a variable VMT tax schedule based on the weight of the vehicle. Transition from gas tax to VMT based on the ratio of gas vehicles to alt fuel vehicles over time.
