The ability to enact money bills (i.e., that appropriate funds or impose taxes) is also limited in the House of Commons in that they need a royal recommendation; meaning they can only pass 3rd Reading if the Government (i.e., Cabinet) agrees to it.

You are not required to wait politely. Peaceful protests are an essential aspect of our democracy. They, and similar methods, help ensure governments don’t implement policies people oppose.

But a government going in a direction many, or even most, people dislike isn’t necessarily fascist.

I would say time for *Albertans* to show up. When it becomes clear that voters will punish a government electorally if a course of action isn’t reversed, a reversal happens. Albertans who value this Charter right need to stand up, and not just hope that others will.

The notwithstanding clause has never been invoked in any jurisdiction to end a labour action. And we’ve seen, with Air Canada flight attendants, that even an arguably constitutional back-to-work order may result in escalation, not resolution.

If, for instance, there is widespread defiance of back-to-work legislation, or other unions engage in labour action as a result of this legislation, I would think the government would want to make sure the public puts the blame on labour. This may not help them achieve that.

I admit that I am not adept at how one manages political considerations. So, maybe there is a rationale that I just don’t see. Because this looks like it could very well be an own-goal, especially since I understand polling favours teachers in this labour action.

But preemptively invoking the notwithstanding clause is to cede the moral high ground right from the start. The government would be admitting that it does not believe it had earnestly bargained in good faith, and failed to reach an agreement despite that.

Unless and until the courts held that the back-to-work legislation is unconstitutional (I’m not guessing either way), the government could claim that legislation was an unfortunate, but necessary, action to resolve an impasse.

I am not sure why the government would preemptively invoke the notwithstanding clause (if this report is correct). It is not automatically the case that legislating back-to-work would violate the Charter. In any event, it would be months before courts would rule on the constitutionality.

If fligth attendants can refuse a back-to-work order, I suspect that teachers, who already have demonstrated a strong willingness to fight even without any strike pay, may respond to a s. 33 override of their collective bargaining rights by engaging in a wildcat strike.
