They either havenβt read it or are lying about it.
And then people wring their hands about trust in institutions or bemoan people resorting to social media for news.
All published judgements set precedent, the question is whether it is binding precedent or persuasive precedent.
A High Court judge should take account of the practical realities of senior ET judges navigating these issues.

Scotrail have a good national flag livery - because the designer understood dark colour blocks work on trains! Diagonal bright stripes don't.
A coherent nationwide brand is a good thing. BR put a lot of thought into its corporate livery, and it is part of getting a national rail system right.
The problem is they let a flag wanker with no concept of liveries on a train work do it.
Like - you can't ignore the human rights act, refuse to hear submissions from any trans person, welcome submissions from anti-trans lobbyists, rule against the understanding the laws authors had, and then be upset people criricise the fact you've trashed people's human rights.
