Democrats also tend to exercise significant prosecutorial discretion, while Republicans do not. That makes a big difference.

I've asked this before, and I'll ask it again: What would have happened had Justice Jackson bucked β€œnorms” and ruled in this stay application without referring it to the full court?

Are you kidding? The whole point of the CASA opinion was that nationwide injunctions were an impermissible workaround the R.23 procedures, and that if you want this kind of relief, you have to use R.23. Today’s decision is a direct application of the CASA opinion, gymnastics-free.

What would have happened if Justice Jackson had just ruled on the stay application without referring it to the full court? It’s time to start considering that in these emergency applications.

Not sure how it can be an β€œofficial act” if the law expressly forbids it specifically by the President, unless the law is held invalid as a violation of separation of powers.

Important to note that, based on recent visa revocation activity for F-1 students, even a speeding ticket that is dismissed could result in a visa revocation. No finding of guilt required, apparently.

Judge Crawford, summing up his finding on due process: "If the Government detained Mr. Mahdawi as punishment for his speech, that purpose is not legitimate, regardless of any alleged First Amendment violation. Immigration detention cannot be motivated by a punitive purpose."

A Mother and Father Were Deported Under Trump. But What Happened to Their Daughter? The Trump administration sent the mother of a 2-year-old to Venezuela and the father to a Salvadoran prison. Their daughter remains somewhere in the United States.

Another horrible story of family separation.

Also, USCIS has now issued at least one NOID to a change of status applicant asserting the applicant failed to maintain nonimmigrant status because their SEVIS was terminated. ICE’s litigation position does not match DHS’s real-world position.

More use of β€œtech” to enforce the whims of government. Not all that different from the strategy used in the recent SEVIS terminations. Forget about the law, just β€œdelete”.

You know what is waste, fraud, and abuse? Raising filing fees under the guise of improving service and then firing workers (or even worse, using those fees to offer buyouts).

Why move to terminate 240 proceedings in favor of ER, when ICE can just β€œterminate” them in the system, right? Just like the wave of SEVIS terminations. Forget procedure - just delete. Musk has taught them well.
