When they filed this back in November, I almost emailed their attorney with links to the sanctions hearing of Powell, Woods, et al in the Eastern District of Michigan.
Now this poor bastard is being similarly hammered for violating Federal Rules of Civil Procedure.

If it consoles you just a bit, they had to eat into their donations by having to revise their complaint.

Shit, I'm blanking, but isn't there a lawyer with election experience among our BlueSky cadre?

In general, election security experts disfavor DREs because they open up the door for hacking. The machine can record your vote one way and print out something else. But if accompanied by Risk Limiting Audits it will likely be discovered.

With VVPAT, a DRE prints out your choices. This way you can verify your choices were accurately recorded. This is often kept by the state as the way to do manual recounts.

DRE= Direct Recording Election machine. Like a BMD but records votes DIRECTLY. Use the touchscreen to make your choices, and the machine tabulates your vote. Often comes with VVPAT (Voter Verified Paper Audit Trail).

With miniscule exceptions, hand-marked ballots and BMD-produced ballots are separately scanned by a *tabulation* device.

BMD = Ballot Marking Device. You've probably used one. It has a touchscreen where you select your candidates, and the machine then prints out a ballot. It's used to assist handicapped folks and also more reliably marks the ballot.
The dark green regions have BOTH BMDs and hand-marked ballots.

With all the layers of audits/technology, machine fraud is kinda the dumbest way to steal an election.

Roughly 95% of ballots in the last few elections are all on paper.
And all swing states (and most others) have "Risk Limiting Audits". RLAs are a manual recount of paper ballots of a statistically significant sample of votes.

They use very bad "statistical analysis" (which can all be explained by demographics and bad statistics) but can't explain how this "machine fraud" went undetected by the layers of legislatively-mandated audits and EAC-required technological safeguards.

Don't be. It's likely just gross incompetence. A bunch of amateurs who don't know what they're doing.
But no, they have not shown "possible voting machine manipulation".
The reason why me and Philly jump on this is that they are using the exact same arguments that MAGA has used since 2020.

They are now 3 weeks late on filing their annual report.
The business model is:
1) Raise money for faulty lawsuit and "further research".
2) Lawsuit gets dismissed early for standing, exhausting little of the donations.
3) Profit!
4) Raise more money for inevitable appeal

As an attorney with occasional experience with the Equal Time rule, I can explain what's going on here and how the FCC's Brandon Carr is leveraging his position to force late night and daytime talk show hosts to exclude Democratic candidates.

First I need to explain the Equal Time rule itself. 1/

And there WERE two audits.
Risk Limiting Audits.
Trusted Build Verification.
Logic and Accuracy testing.

This is another thing about the stupidity of the claims: Why would anyone perpetuate a massive election theft operation when it has such a large possibility of it being detected?
"Someone ordered a recount?!? Rats! We did not see this coming!!"

You just weren't paying attention.

And what did you find?
The Trusted Build Verification that detects hacked code?
The Risk Limiting Audits that manually recounted a statistically significant sample of machine tabulated ballots?

16.02.2026 17:38 β€” πŸ‘ 1    πŸ” 0    πŸ’¬ 0    πŸ“Œ 0

It wasn't "unquestioned".
There were layers of audits on the count before certification.
You just weren't paying attention.

16.02.2026 17:35 β€” πŸ‘ 1    πŸ” 0    πŸ’¬ 1    πŸ“Œ 0

Yes. They can be hacked.
That's why we have layers of legislatively mandated audits and EAC-required technological safeguards to detect it.

Did it ever occur to you to google this obvious question?

2) "0.05": That's not 50% probability. That's 5% probability.

And this on top of using an independent variable calculus on dependent events.

But it won YOU over. Huh.
