The irony is that it is just as likely that the big houses on which Austen's works were based were those owned by her brother ... in Kent. So where, exactly, would the Austen landscape be?

I don't disagree that it's about tourism branding ... but there are also times when it is hard to avoid the conclusion that people are clutching to find any excuse to object. At least with Bronte, there is a case for saying landscape is integral to the writing. I'm less convinced about eg Austen

There is a similar campaign to designate and protect a 'Jane Austen' landscape. But if you did that for every famous writer (Hardy, Lawrence, Dickens etc) where could you do anything?

It depends what you mean by "question a court ruling". Once you've exhausted all appeals, it's really important that the final judgment on what the law is, is not questioned. But that doesn't mean you have to accept that's what the law should be: it just means you need Parliament to change it
