I keep seeing people say things like, “Well we’re not going to HAVE elections,” and with all due respect, I think this is both wildly pessimistic and also wildly naive.
We are not going to have free and fair elections. We also have not had them in the past.
I haven't said anything about this, b/c it's taken me some time to sort my feelings. But...I served on the UVA law faculty with Jim Ryan and Liz Magill. I knew from early on that both would be great academic leaders. What has happened to them is a window into the bleak future of US universities. 1/

This isn't going to end until the judges start holding lawyers and DOJ officials in contempt and throwing them in jail.
Even that might not end it, but there's no point trying to delay the inevitable. They're just getting bolder and more destructive as they go.
NEW: DOJ doubles down on refusing to follow Judge Xinis's orders. Today's status report contains nothing new. It again fails to provide information about steps they're taking to bring Mr. Abrego back), and arguably violates her command that a declaration be made by someone with personal knowledge.

25 minutes away from when the DOJ is supposed to file their second daily status report on Mr. Abrego. Yesterday they seemingly refused to provide information on the steps they've taken previously and plan to take in the future to "facilitate his return." Let's see if they refuse again today.

Of course, that is precisely what the Supreme Court did when it ruled that this Court's injunction "properly requires the Government to 'facilitate' Abrego Garcia's release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador." Noem et al. v. Abrego Garcia et al., 604 U.S. 2025 WL 1077101, at *1 (Apr. 10, 2025). The Government should be required to comply with the Supreme Court's order that it "ensure that his case is handled as it would have been had he not been improperly sent to El Salvador," by taking all available steps to release and return Abrego Garcia to Maryland.
In accordance with the Court's Order authorizing Plaintiffs to seek additional relief beyond what this Court previously ordered, ECF No. 61 at 2, Plaintiffs request that the Court order three additional types of relief. First, order the Government to take by end of the day Monday, April 14, 2024, the specific steps set forth below to comply with the injunction in this case. Unless there was another sealed filing which isn’t on the docket (a real possibility), it would appear that the administration has failed to provide the required information about what they are doing to try to get him back.

We knew they were going to drive a truck through that deference language. Roberts is either going to have to grow a pair and unequivocally slap Trump down or just quit pretending SCOTUS cares anymore.

Agreed. But man oh man SCOTUS could & should have issues this decision on Monday. Mr. Abrego-Garcia is still sitting in that crazy prison El Salvador (if he’s in fact still alive). Disgusted at all of this.

But the longer it takes, the more it suggests that there isn't a majority of the Court who views this dispute with the same *urgency* that so many of us do. And that's a problem unto itself.
Still waiting for a SCOTUS decision on whether Kilmar Abrego should be returned to the U.S. or not. One imagines that the hold-up is someone or someones writing concurring or dissenting opinions.
In the meantime, that's another day and night in a terrible prison for Abrego.
Gotta say, I am not encouraged that SCOTUS has not yet resolved the El Salvador kidnapping case.
