We show that the financialization of the ocean is in conflict with both the ”just compensation” standard required by the compact between American Samoa and the United States; and is in conflict with indigenous values, both of which are legally protected by the 1900 and 1904 Treaties of Cession.

In this paper, we compare indigenous views on Ocean governance with the logics of financialization. We describe the speculative logics driving DSM in the absence of commercial viability of an untested business to retrieve low value minerals from the most difficult environments on the planet.
