I agree, but the landscape of how SCOTUS weighs our rights has changed. The constitutionality of the fairness doctrine was predicated on government spectrum licensing and saying the publicโ€™s rights for diverse viewpoints outweighs the broadcasters rights. That reasoning seems less likely today.
