No, no, that’s correct. My apologies. I thought the article was reporting the whole compensatory damages award, not the prorated amount. Still, it’s hard to see how the amount is left undisturbed.

This is not accurate, though it is the framing generally employed by the media. The jury allocated most of the fault to driver, and the total damages Tesla may have to pay will be reduced by the driver’s proportion of fault.

The state’s response was the standard response to any citizen initiative: Pound sand. We were lucky to have a supreme court that pushed back.

It’s a hard thing to do.

Originalism at the state level? It’s been going on for a few years now. Excluding this new one, I have written three articles applying PMO to the Florida constitution. Two were/are forthcoming in the Stetson Law Review; the third in the Florida Bar Journal.
