What a fascinating career.

Appellate lawyer in Florida. Defund SCOTUS.
What a fascinating career.
08.10.2025 23:48 β π 2 π 0 π¬ 0 π 0I skimmed Ness's (really good) order. He also seems to be saying that the Schedule A plaintiff's papers weren't facially sufficient to warrant the requested relief. That's something the judge can determine, and I fail to see how the ex parte nature of the proceeding precludes that.
08.10.2025 17:02 β π 1 π 0 π¬ 0 π 0Solum and Barnett have a draft paper, "Originalism and the Party Presentation Principle," that discusses the PPP at length. papers.ssrn.com/sol3/papers....
08.10.2025 16:40 β π 1 π 0 π¬ 0 π 0My understanding is that the PPP limits the court's ability to raise legal issues and arguments outside the pleadings and dig up facts on its own. In Schedule A cases, the court is just enforcing rules and managing cases, which it has the authority to do.
08.10.2025 16:39 β π 1 π 0 π¬ 2 π 0That doesn't comport with this litigator's understanding of the party-presentation principle....
08.10.2025 16:02 β π 1 π 0 π¬ 1 π 0Crimes against humanity. These monsters should face an international tribunal.

Or βconstitutional litigator but really a zealot at the ADF or another Leonard Leo-funded hate group.β
08.10.2025 11:08 β π 0 π 0 π¬ 0 π 0And also the selection of locations. E.g., Florida is a gerrymandered red state but with a large Hispanic population that, while Trump friendly in 2024, is not a guaranteed GOP vote.
07.10.2025 22:37 β π 0 π 0 π¬ 0 π 0I was joking!
07.10.2025 03:47 β π 1 π 0 π¬ 1 π 0Pritzker is an oligarch. Why does he not simply have his own private army?
07.10.2025 03:41 β π 1 π 0 π¬ 1 π 0Judges should not wear robes.

06.10.2025 23:58 β π 22 π 1 π¬ 0 π 0Yes: That if you write and sign them, then hold firm, you can be appointed a federal circuit judge or a law professor.
06.10.2025 23:49 β π 0 π 0 π¬ 0 π 0It also does not cost zero time, because nearly everyone I have seen backing in has to adjust the car several times to line up with the space.
06.10.2025 14:38 β π 1 π 0 π¬ 3 π 0What about backing in?
06.10.2025 13:28 β π 0 π 0 π¬ 1 π 0One of the biggest narcissists who ever lived.
06.10.2025 11:48 β π 1 π 0 π¬ 0 π 0Trump I judges are largely FedSoc hacks, and theyβre game for much of what Trump wants to do, but theyβre no Emil Boves!
06.10.2025 11:42 β π 2 π 0 π¬ 0 π 0Sleep paralysis demon.
05.10.2025 23:28 β π 2 π 0 π¬ 0 π 0Convenient!
05.10.2025 21:31 β π 4 π 0 π¬ 0 π 0Itβs been revealing! I thought Randy Barnett was a serious scholar. Turns out heβs a crank and a troll. And interestingly, this is at the same time heβs being fΓͺted by the mainstream conservative legal movement.
05.10.2025 17:58 β π 2 π 0 π¬ 1 π 0It is a simple and important idea that more people should understand.
05.10.2025 14:37 β π 1 π 0 π¬ 0 π 0Well, I donβt know how a personal representative can be appointed for my estate in such circumstances, so even that remedy is illusory. Check and mate, Wurman.
05.10.2025 14:34 β π 1 π 0 π¬ 0 π 0Heβs *working* on the *paper* *now*.
05.10.2025 14:24 β π 0 π 0 π¬ 0 π 0And I point out again: A president signed the legal regime into law. The executive branch already agreed to this.
05.10.2025 13:47 β π 1 π 0 π¬ 0 π 0There just *have* to be consequences after this

05.10.2025 13:07 β π 1 π 0 π¬ 1 π 0An article I co-wrote on precedent (not crim law) was cited several times in the separate opinions!
