I skimmed Ness's (really good) order. He also seems to be saying that the Schedule A plaintiff's papers weren't facially sufficient to warrant the requested relief. That's something the judge can determine, and I fail to see how the ex parte nature of the proceeding precludes that.

Solum and Barnett have a draft paper, "Originalism and the Party Presentation Principle," that discusses the PPP at length. papers.ssrn.com/sol3/papers....

My understanding is that the PPP limits the court's ability to raise legal issues and arguments outside the pleadings and dig up facts on its own. In Schedule A cases, the court is just enforcing rules and managing cases, which it has the authority to do.

That doesn't comport with this litigator's understanding of the party-presentation principle....

It’s been revealing! I thought Randy Barnett was a serious scholar. Turns out he’s a crank and a troll. And interestingly, this is at the same time he’s being fêted by the mainstream conservative legal movement.
