I skimmed Ness's (really good) order. He also seems to be saying that the Schedule A plaintiff's papers weren't facially sufficient to warrant the requested relief. That's something the judge can determine, and I fail to see how the ex parte nature of the proceeding precludes that.

My understanding is that the PPP limits the court's ability to raise legal issues and arguments outside the pleadings and dig up facts on its own. In Schedule A cases, the court is just enforcing rules and managing cases, which it has the authority to do.
