Given that the 'full' guidance will be issued later in the year, surely all this legal effort needs to be given to that, rather than the 'interim' guidance that has now already been replaced by the full guidance? Won't you have to do all this later in year again? Am I missing something ?

If a service provider provides single- or separate sex services for women
and men, or provides services differently to women and men, they should treat transsexual people according to the gender role in which they present. However, the Act does permit the service provider to provide a different service or exclude a person from the service who is proposing to undergo, is undergoing or who has undergone gender reassignment. This will only be lawful where the exclusion is a proportionate means of achieving a legitimate.

This applies whether the person has a Gender Recognition Certificate or not.

In some cases, guidance reflected the organisationโ€™s own policy to allow those with the โ€˜gender reassignmentโ€™ protected characteristic access to single-sex spaces that correspond with their self-identified gender, but did not incorrectly suggest that this is mandated by the Act. Had organisations suggested that their policy was mandated by the Act, however, this would have been a clear misinterpretation of the law.

Using services based on โ€œself IDโ€ (the gender role in which they present) regardless of GRC is right there in the EHRCโ€™s 2011 Code of Practice.
