Help us appeal the High Court’s judgment on trans rights | Good Law Project

Hi everyone. As you know, I am our trans rights lead at Good Law Project. I have been working alongside a fantastic team on our challenge since May last year. But whilst what we have achieved is significant - there is still a lot further to go.

If you can, please donate and help us keep fighting.

Illegal immigration is a world wide problem

When the results of the Brexit referendum came through, I remember a lot of Brexiteers saying that it was only the start. They would never explain what they meant but it's becoming clearer. How many of the 650k who tipped the balance actually support the additional steps?

Today’s High Court ruling found trans employees may be segregated in British changing rooms and toilets. I’ve written to my union, @actorsequity.bsky.social , to ask how we’ll be fighting to ensure govt guidance doesn’t permit that. British actors deserve dignity at work and that means *all* of us.

Can you please highlight to equality minister the absurdity that a trans woman could be allowed to use a toilet if a service user, banned from the same toilet if an employee on shift, but allowed to enter the same toilet (though not use it) if they were employed to clean it

The Epstein Class's 'death by a thousand columnists/bots/lawyers' Standard Operating Procedure:

-Seed media moral panic
-Feign respect for 'the truth/science/law'
-Claim truth/science/law is suspect
-Cook books to ban truth/science/law outside limited scenario

Trans people facing β€˜workers’ rights crisis’ after latest ruling, campaigners says But a High Court judge said service providers should be β€˜guided by common sense and benevolence’ when providing toilet facilities to trans people

Beyond how reprehensible and callous this is, lack of legal recognition causing people to be outed at work and subject to mistreatment was central to the Goodwin/I decisions. It's so bizarre.

Just commemorated the latest confused judgment from the High Court by taking a piss in the ladies at Carlisle Station

Next week I'll do the same at work.

Segregation can and must be resisted every day, by every one of us who is able to do so.

I transitioned twenty years ago & in all that time I’ve used the toilets that align with my gender identity where I work with no issues & with the support of my c!s work colleagues & the nearest gender neutral toilet is on the ground floor & I’ll have to take a lift & go down 3 floors to reach it.

One thing I can say the High Court would agree with me and GLP v EHRC demonstrates that Ben Cooper KC has lied to the Supreme Court.

We've written to Bridget Phillipson to point out she's legally obliged to reject the EHRC's draft guidance

The Government committed in its manifesto to β€œremove indignities for trans people”. We're asking that they take steps to protect the trans community & correct what the Supreme Court got wrong

We know that when institutions, particularly those that do not share our community’s empathy for one another, release new proposed guidelines, it can be stressful. That's why we’re taking time to break it down and will post our thoughts soon."

We wanted to acknowledge the proposed updates to the Keeping Children Safe in Education (KCSIE) guidance released yesterday.

Full statement to follow.

We’re operating in an increasingly hostile environment, where it’s harder to fund, publish, and find balanced, nuanced journalism about LGBTQIA+ lives.Β

Can I ask @genderedintelligence.co.uk why they are describing this horror thus:

β€˜It’s positive to see guidance that begins from a place of support, not exclusion".

Please ask the journalist to update to your commentary to recognise how awful this guidance is for trans kids.

Trans children β€˜will lose any hope of happiness’ under school gender guidance 'Trans children need to be supported and respected.'

Children will lose any hope of happiness under school gender guidance:

"It will lead to children avoiding the bathroom, avoiding exercise, missing out on school trips, dropping out of school, losing any hope of education, equality, friendship, happiness. This new guidance is totalitarian, dangerous, and will completely devastate the lives of trans children". 3/

"Trans children need to be supported & respected in order to be safe at school, in order to access their right to education, in order to enjoy their childhood. Instead, we have a complete ban on access to appropriate toilets, PE, accommodation on school trips, a complete erosion of their rights" 2/

β€œThe legal situation for trans people, employers and service providers is now completely incoherent. What bathroom a trans person can use in a pub may now depend whether they are there as an employee or for a drink. We are pleased the court has confirmed that the Equality Act does not function as a bathroom ban, but outdated workplace regulations have failed to keep up with modern times and last year’s Supreme Court judgment has made them entirely unworkable.

β€œThis risks outing trans people at work, who may have been using gendered facilities without issue for years - and it is unclear how trans people without access to gender neutral facilities will be able to do their jobs. This is a worker's rights crisis for the trans community, and one which will cause issues for employers across the country.

β€œThe High Court has clarified that trans people should not be forced to use facilities in line with their birth sex, but it is hard to see how treating us as a 'third sex' at work aligns with the privacy protections in the Gender Recognition Act or the Human Rights Act. We must be allowed to transition and move on with our lives with privacy, not be outed every day at work.”

Our take on the judgment: incoherent, unworkable and needs to be fixed or we face a workers rights crisis. We will be campaigning hard to fix this mess, watch this space.

So if you're a trans person working at a pub, you now have to either hold it in all day or breach your life-saving defences against social murder by using the Gender Traitor toilet

But the moment you end your shift you become a full human being again.

Right, ok. 'Welcome clarity'

If you're looking to understand if this is good news or bad news - there is no easy answer: This judgement is both.

It establishes an important legal principle that in most public life - segregation is not lawful.

But in the workplace, it says something very different πŸ‘‡
