According to the judge Mr Makepeace, if you’re a trans woman suffering from the stress of state violence in the form of malicious prosecution and lose your ability to “pass” that must mean you’re part of a conspiracy to undermine the court, you deserve a harsher sentence. He fucking spelled it out.

4/ Under English law, consent cannot be conditional. It can only be vitiated if doing so aligns with public policy, and such policy must be rational. I contend that the policy appears irrational and cannot be applied consistently. Consequently, consent cannot be vitiated in the case of Watkin.

I wrote an article in January about where we have ended up in English law re. "deception as to sex", and what that means for trans people. I think it's likely we can expect to see more of these sorts of cases going forward.

The judiciary has created such a mess that enables abusive men and criminalises Other-ness. I can't begin to comprehend how actively lying about a vasectomy (and causing pregnancy) isn't proximate enough to the sex act to vitiate consent while giving a blowjob as a trans woman ~is~ sufficient

To put it in blunt terms, judges across multiple cases have essentially taken the line that their strongly held popular prejudices cannot possibly conflict with the law, which must instead be read in their light.

What rights do trans people not have?

The Article 7 right to protection from retrospective application of criminal law.

When the Supreme Court can act as if trans people never had rights, retroactively redefine “sex” in the 1974, 1975, and 2010 Acts of Parliament, and somehow deem criminal law to incorporate that by reference, who even needs to persuade the legislature to pass laws criminalising trans people?

5/ Recorder Makepeace is not just complicit in this injustice. He made it clear that he views trans identities and sexual orientations as forms of deception and indicators of repeat offending. Despite knowing how vulnerable the true victim is, he chose to punch down on her.

Alright, I’ve now fully exhausted all the administrative avenues regarding the Cass Review freedom of information requests. Time for a judicial review next? I’ll need to seek legal advice.
