last night as i was trying to wind down for bed i had a unified theory of what the fuck just happened, and i wrote it down, and filed it under "well, i can't talk about this on main without sounding insane until and unless the perp gets caught and is provably a groyper"

anyways, great news! (1/X)

Important Texas news: last fall, Bolts reported that the sheriff of Fort Worth was flouting a state law that requires independent investigations of deaths in jails.

Well, as a result of that reporting, a Texas state agency has now taken charge of assigning who must investigate a death.

๐Ÿงต When authoritarian leaders attack judges as "enemies," history shows us exactly where this leads. Trump's assault on "USA HATING JUDGES" isn't just inflammatory rhetoricโ€”it's following a script written by strongmen worldwide. But other countries show us how to fight back.

A Pennsylvania county forgave more than $65 million in โ€œpay-to-stayโ€ debt; this was money that had been charged to detained people for โ€œroom and boardโ€ at the local jail.

This Essay argues that the Twenty-Second Amendment is enforceable by the states against any two-term Presidentโ€”including Donald Trumpโ€”who attempts to evade its requirements and seek an extraconstitutional third term anyway. Whether Trump actually seeks such a term is an open question, though he professes to be serious about doing so, and allegedly sees multiple โ€œmethodsโ€ for appearing on the ballot. The narrow argument that the Twenty-Second Amendment technically allows a third presidential term under some circumstancesโ€”i.e., by allowing a President to run for Vice Presidentโ€”has not been tested, but it may soon be.

If such a theory is tested, it is a reasonable fear that the U.S. Supreme Courtโ€™s decision in Trump v. Anderson may preclude state enforcement of the Twenty-Second Amendment. I argue that Anderson, which solely concerned the enforceability of Section 3 of the Fourteenth Amendment, has no purchase in this context. The context, text, and procedural demands of the Fourteenth Amendment differ in every way from the Twenty-Second Amendment. As such, states are not only free to enforce it against two-term presidents, but they must do soโ€”because there are no other viable entry points for enforcement.

I was frustrated and angry about how the conversation about the Twenty-Second Amendment was developing, and in an effort to prevent, idk, an entire literature from developing overnight??? I wrote something about it. we'll see how the law reviews feel about a short essay very late in the cycle.

A tricky thing about modern society is that no one has any idea when they donโ€™t die.

Like, the number of lives saved by controlling air pollution in America is probably over 200,000 per year, but the number of people who think their life was saved by controlling air pollution is zero.
