The issue with this is that it presumes that there is a point to legislative reforms without court reforms. As the current court has shown us, there absolutely is not because they will shred or not apply and law they don't like. Court reform is not optional, it is the precondition to everything.

There is a reason no other country with a successful repro movement grounds it in privacy. It is politically ineffective and does not match what is actually needed on a policy basis. Accepting you won't win at the court frees you up for other victories.

The emphasis on "privacy" in pro-choice work is almost entirely due to the way that Roe was decided, previously you see much more language around gender equity etc. But the lawyers became the tail that wags the dog.
