I think that is the current meaning. I don't understand the hate for the term which is about as innocuous as a term can be.

The problem with common sense (or "discretion") is that it is costly to implement and likely to be inconsistent and unreliable.

Its probably easier and (much) cheaper to have a law "don't throw waste down the drain" than to have a law "don't throw waste down the drain if it is provably harmful." A lot of apparently crazy rules can be understood this way.
