Lol, it's not artificial intelligence, that's just what they call it. It doesn't have rights, it's a company's product.

Exactly this. I have lots of examples of where it basically shifts it into some form of 3-point portrait lighting to gloss it up. They have a rating system to help them tune their models, and it's clear the people ranking them gravitate towards generic, safe lighting with punched up details.

He's not suggesting that at all, and he's rightfully pointing out you have less than no clue about what you're talking about. You're engaged in a vibes based argument against facts. Give it up.

Midjourney banned me 3 times and updated their terms of service without notifying users (which is illegal) because I exposed them. They've banned others simply for being critical of them. Does that sound like they're doing things ethically and legally to you?

So you don't see a problem when it can return copyrighted images that Midjourney profits from generating, and a user might go and use and profit from, not realizing it's copyright protected intellectual property? I understand you love AI, but you're not going to win this one, sorry.

It wouldn't change anything I don't think, selling fan art is and always has been illegal. Companies look the other way a lot of the time because it's typically not worth pursuing if you're small enough, but they're well within their legal right to go after you at any time.

In the Disney lawsuit, 10 pages are dedicated to citing the work we did. In pursuit of this evidence, Midjourney banned me 3 times and updated their ToS. The first ban encouraged me to dig a lot deeper, so I'd like to congratulate CEO David Holz on his massive unforced error.

This could easily be the end of Midjourney.

Data can't be removed from a model once it's embedded. It would force them to retrain a model from scratch without the infringing data, which would be incredibly expensive, on top of damages they're forced to pay. If they leave other infringing work in, they're liable to get sued for that too.

Our work is like 10/110 pages of the filing, absolutely flabbergasted. I'm so glad it paid off.

This lawsuit is brutal. One of the exhibits is the letter Universal sent to Midjourney, including a quote from a 2022 Forbes interview that I bet midjourney regrets
