Hello,

I am a trans woman who lives in Bristol. I am writing to strongly oppose the motion to record birth sex as "biological sex" on patient records. I, along with the majority of trans people I've spoken with, oppose this for two main reasons. Firstly it is a violation of our privacy and dignity, and secondly it is factually false to conflate birth sex and current sex, which will lead to poor healthcare decisions.

There is no medical benefit to listing birth sex, and it is misleading to use birth sex as "biological sex". As a woman who has had normal female hormone levels for over a decade, and who has none of the organs typically associated with male bodies, recording me as male could cause practitioners to make healthcare decisions based on a body that I do not have. It could lead us to miss out on vital screenings such as breast cancer screenings, and it could lead to incorrect dosing or interpreting of symptoms.Trans and intersex people's bodies do not fit into the standard two category system that most others do, but if we are forced to fit into that system then our current sex - what our actual bodies are like today - is far more indicative and safe to use than birth sex, which only relates to what I was like over 30 years ago.

I have personally experienced prejudice in a medical setting when I revealed I was trans, for an unrelated condition, and I do not want to face that again. It put me off going to the doctor for years, which meant that I missed out on checkups and treatment for asthma. It has been a long, long time since anyone called me "Mr" or referred to me as a man, but I fear that incorrectly recording our "biological sex" on records will lead to this again. It feels invasive and unnecessary. I also believe it is a violation of our legal right to a private life guaranteed by the European Court of Human Rights.

The EHRC interpretation is guidance only, not law. Schools have to put the welfare of the child first and any fair & informed school should see this. My daughter socially transitioned in yr 5. She’s been using girls facilities since then and is just about to sit her GCSEs. 2/3
