I know a US citizen that was arrested by ICE & appeared in fed court 3x b4 the charges were dropped. I don't know the specifics of the law, but ICE was definitely arresting, charging & sending folks to court for those charges. Case was dismissed for lack of evidence, not b/c the charges were invalid
