When the Executive publicly announces its intent to break the law, and then executes on that promise, it is the Judiciary’s duty to check that lawlessness, not expedite it. Two lower courts rose to the occasion, preliminarily enjoining the mass firings while the litigation remains ongoing. Rather than maintain the status quo, however, this Court now intervenes, lifting the injunction and permitting the Government to proceed with dismantling the Department. That decision is indefensible. It hands the Executive the power to repeal statutes by firing all those necessary to carry them out. The majority is either willfully blind to the implications of its ruling or naive, but either way the threat to our Constitution’s separation of powers is grave. Unable to join in this misuse of our emergency docket, I respectfully dissent.

Last week, DHS and Secretary Noem's staff and spokespeople suggested that because Mr. Abrego Garcia had $1,100 in cash on him when arrested outside Home Depot seeking day labor, that was strong evidence that he was a member of MS-13.
I guess that raises a similar question about her $3,000.
I don't really care what the "political consequences" are of fighting for the proposition that *everyone* is entitled to due process before they are removed from the United States and sent to a Salvadoran prison.
It's not really a principle if you only adhere to it when it's politically expedient.
As far as I can tell, the first person to ever accuse him of human trafficking is Leavitt herself (I'd love to know if someone else made the claim first).
Certainly, no official has ever made that claim to a court, nor offered any evidence of it whatsoever. It seems the White House made it up.
Even if you (wrongly) believe that some immigrants lack due process rights, what’s to stop the government from claiming that *you* are an undocumented immigrant; removing you to El Salvador; citing an “administrative error”; and refusing to do anything to bring you back?
The answer is due process.
