Another example of the "better messaging" fallacy. Despite all evidence, people continue to believe that electoral outcomes are primarily determined by the quality of messaging. Too much of the shouting on social media is wasted on this pointless activity.

I guess it doesn't matter so much if the losing party doesn't file new briefs in such a situation. Either they get an unexpected second bite at the apple, or the case returns to the status quo before the en banc rehearing. Either way, they are not made worse off.

I don't think this is as strange as you think. A quick search suggests that other circuit courts also allow a sua sponte rehearing en banc. The fifth circuit's internal rules expressly allow for such:
