There may well have been news value in reporting the facts of it. As I recall they put an uncensored video up on their site, which Bollea claimed caused emotional distress. I doubt he'd have swayed the jury if it was just a factual story. Please correct me if I'm misremembering that.

Not a lawyer so I won't claim a legal argument. I didn't see any societal value in publishing someone's sex tape. Outing Thiel maybe did have a purpose & I think why he chose the sex tape as a vehicle. I'd have definitely defended publishing the facts of the tape & a nonsalacious still as proof.

I took a lot of shit at the time for criticizing it. I did think Gawker deserved to lose but Thiel brought so much money & power to the case he was able (and intended) to kill the whole company. I said it was a bad precedent to let billionaires buy their goals through the legal system.
