And the answer is: no the police can make their own decision.
Just as the police have already said they will pause making further arrests.

One of the by-products of the Mandelson affair has been a rebalancing of power within the government in favour of Labour's "soft left". Morgan McSweeney, who resigned as chief of staff to the prime minister on Sunday, was important not only for the political acumen he brought to No10 but his economic realism, a scarce commodity in his party. Now Mr McSweeney is no more, the field has been yielded to the likes of Ed Miliband, secretary of state for energy security and net zero.
Mr Miliband, like the rest of his cabinet col-leagues, has never run a serious company, but that does not stop him thinking he knows best for Britain's businesses, presently struggling with the highest energy bills in the club of advanced nations. The answer, he says, is a dash for wind that will create an almost decarbonised electricity grid by 2030. This, Mr Miliband once pledged, would eventually lower domestic bills by Β£300 per household per year. That promise has duly evaporated, along with the jobs of workers in Britain's offshore gas and oil industry, casualties of his other great obsession: ending exploration in the United Kingdom sector of the North Sea.
Given the amount of briefing against Miliband in the RW media, they must view him as a serious threat. No wonder The Times is praising McSweeney's political acumen, since he's managed to undermine Labour support and agitated for Miliband to be moved.
