Note that the current law 199A phase-out imposes even *higher* EMTRs for taxpayers with a large amount of QBI. Easy to construct examples with EMTRs>100% under current law.

I think youβre underestimating the effect of the 199A phase-out. In the phase-out region, the bill changes the phase-out such that every dollar you earn now reduces your QBID by $0.75. That means your EMTR is 37%*0.75 = 27.8 pp higher from the 199A phaseout alone.

Very useful Treasury (OTA) estimates of the revenue costs and distribution effects of TCJA extension options. Usefully includes a breakdown of business provision reversals as well. Full extension/reversals costs $5.5 trillion over budget window.
